1. Acceptance of Terms

By accessing or using BeatVid AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

BeatVid AI is a platform that generates AI-powered music videos from audio files. Users upload audio, provide style prompts, and receive AI-generated video content. The Service uses third-party AI models for video generation.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use the Service.

4. Payments and Refund Policy

  • Account funds are used within BeatVid AI for video generation.
  • Account funds are non-refundable and non-transferable, except where required by law.
  • Video generation is processed by third-party GPU rendering services and incurs irrecoverable costs the moment generation begins.
  • Once generation starts, funds consumed cannot be refunded regardless of whether you are satisfied with the output. By initiating generation, you acknowledge and accept this non-refundable charge.
  • Your account is only refunded automatically when generation fails due to a technical error on our side.
  • We strongly recommend starting with lower-cost, shorter test videos before committing to full-quality, full-length generation.
  • We reserve the right to modify pricing with reasonable notice.

5. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or abusive content
  • Infringe on the intellectual property rights of others
  • Generate deepfakes or misleading content intended to deceive
  • Circumvent rate limits or abuse the API
  • Resell or redistribute the Service without authorization

6. User-Generated Content Liability

BeatVid AI is a tool that facilitates AI video generation. You are solely responsible for all content you create using the Service, including any audio you upload, prompts you provide, reference images you supply, and the resulting AI-generated videos. BeatVid AI does not review, endorse, or assume any liability for content generated by users.

You must ensure that all content you create, distribute, or publish using the Service complies with all applicable laws, including but not limited to copyright, trademark, defamation, privacy, and obscenity laws. BeatVid AI reserves the right to remove any content or suspend any account that violates these terms or applicable law, without prior notice.

7. Content Ownership

You retain ownership of audio content you upload. AI-generated videos are provided under a license that grants you full commercial usage rights for paid plans. Free-tier users may use generated content for personal and non-commercial purposes.

7a. Promotional License

By creating videos using BeatVid AI, you grant BeatVid AI a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and promote your generated videos on the BeatVid website — including but not limited to the landing page, creation page, and marketing materials — for advertising and promotional purposes.

This promotional license does not transfer ownership of your content. You retain all rights to your videos as described in Section 7 above. BeatVid AI will not sell or sublicense your content to third parties outside of promoting the BeatVid platform.

8. Indemnification

You agree to indemnify, defend, and hold harmless BeatVid AI, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content you create, upload, or distribute using the Service; (b) your violation of these Terms of Service; or (c) your violation of any rights of a third party.

9. AI-Generated Content Disclaimer

AI-generated videos may contain visual imperfections, artifacts, or unintended output. BeatVid AI makes no guarantees regarding the accuracy, quality, consistency, or appropriateness of any AI-generated content. Output quality depends on many factors including prompt specificity, model selection, and the inherent limitations of current AI technology.

You are responsible for reviewing all generated content before publishing, distributing, or using it for any purpose. BeatVid AI shall not be held liable for any consequences arising from the use or distribution of AI-generated content.

10. API Access

API access is available to Creator plan subscribers. API keys must be kept confidential. We reserve the right to revoke API access for abuse or violation of these terms. Rate limits apply to all API usage.

11. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service at any time with reasonable notice. Scheduled maintenance will be announced in advance when possible.

12. Limitation of Liability

BeatVid AI is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months prior to the event giving rise to the claim.

13. Termination

We may terminate or suspend your account for violation of these terms. You may delete your account at any time through the settings page. Upon termination, your content may be deleted after a reasonable retention period.

14. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of significant changes via email or in-app notification.
